These Terms of Service ("Terms") govern your access to and use of TikkaBurrito ("TikkaBurrito," "we," "us," or "our"), including our website, AI-powered app builder, chat, voice, SMS, WhatsApp, preview, deployment, support, and related services (collectively, the "Service"). By accessing or using the Service, creating an account, calling or texting us, sending a WhatsApp message, building an app, or clicking to accept these Terms, you agree to these Terms and our Privacy Policy.
1. Eligibility and Accounts
You must be legally able to enter into these Terms. If you use the Service on behalf of a business, organization, or other person, you represent that you have authority to bind that party and that "you" includes that party.
You are responsible for your account credentials, devices, API keys, connected-service permissions, and all activity under your account. You must provide accurate account and contact information and promptly tell us if you believe your account or phone number has been compromised.
2. The Service
TikkaBurrito helps users describe, generate, preview, edit, deploy, and manage software applications using AI and automation. The Service may include web chat, browser voice, phone calls, SMS, WhatsApp, generated source code, hosted previews, Vercel deployments, GitHub integrations, database setup, custom domains, support workflows, analytics, and other features.
We may add, change, suspend, limit, or discontinue features at any time. Some features may be experimental, beta, rate-limited, region-limited, dependent on third parties, or available only on certain plans.
3. User Content and Generated Output
"User Content" means prompts, text, messages, calls, recordings, transcripts, files, images, screenshots, app requirements, credentials you provide, project data, support messages, feedback, and other material you submit to the Service. "Output" means code, designs, plans, text, summaries, files, tests, previews, and other material generated through the Service.
As between you and TikkaBurrito, you retain the rights you have in your User Content, and we assign to you any rights we may have in Output generated specifically for your project, subject to these Terms, third-party rights, open-source licenses, provider terms, and your payment obligations.
You grant TikkaBurrito a worldwide, non-exclusive, royalty-free, sublicensable license to host, copy, process, transmit, display, perform, modify, create derivative works from, analyze, debug, secure, retain, and otherwise use User Content and Output as needed to provide, maintain, protect, support, evaluate, improve, train, and operate the Service and related AI systems. This license continues for as long as needed for those purposes, including backups, security, legal compliance, dispute resolution, and active projects, unless a separate written agreement says otherwise.
4. AI Output Review and Responsibility
AI-generated Output can be wrong, incomplete, insecure, offensive, unreliable, duplicative, infringing, vulnerable, unsuitable for production, or unsuitable for your intended use. You are responsible for reviewing, testing, validating, securing, licensing, and approving any Output before publishing, deploying, selling, relying on, or using it in production.
The Service is not legal, medical, financial, tax, accounting, safety, security-audit, or professional advice. You must not rely on the Service for high-risk, regulated, life-critical, emergency, or safety-critical uses unless you have independent expert review and all legally required controls.
5. Public Apps, End Users, and Compliance
You are responsible for the apps, websites, databases, integrations, domains, messages, content, products, and services you create or operate through TikkaBurrito. This includes your responsibility for privacy notices, terms, consent flows, accessibility, security, backups, data processing agreements, intellectual-property rights, export controls, consumer protection, payments, taxes, industry rules, and laws that apply to your app and its end users.
If your generated app collects personal information, sends messages, accepts payments, stores sensitive data, uses cookies, connects to third-party APIs, or is offered to others, you must provide appropriate notices and obtain all required consents. You are solely responsible for the data you collect from your own end users.
6. Acceptable Use
You may not use the Service to:
- Violate laws, regulations, contracts, court orders, or third-party rights.
- Build, host, deploy, or distribute malware, phishing pages, credential harvesters, spam tools, botnets, exploit kits, or deceptive services.
- Send unsolicited, unlawful, misleading, or non-consensual SMS, WhatsApp, email, voice, or other communications.
- Harass, threaten, impersonate, defame, exploit, discriminate against, or harm any person or group.
- Upload secrets, credentials, personal data, or confidential information that you do not have permission to use.
- Attempt to bypass credits, rate limits, authentication, billing, security controls, abuse controls, or usage restrictions.
- Reverse engineer, scrape, overload, probe, attack, or disrupt the Service or related infrastructure.
- Use the Service to create or support illegal, harmful, deceptive, adult sexual, violent extremist, or otherwise abusive content or activity.
7. SMS, WhatsApp, Voice, and Calls
By providing your phone number, calling us, texting us, sending a WhatsApp message, or opting in through the website or during a call, you consent to receive recurring transactional, account, support, product, and service messages from TikkaBurrito. These may include verification codes, signup links, app preview links, app deployment links, build status, recovery updates, support responses, credit alerts, billing notices, security alerts, product updates, and service announcements.
Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to unsubscribe from SMS messages. Reply HELP for help or contact support@tikkaburrito.com. Carriers are not liable for delayed or undelivered messages.
Calls and voice notes may be recorded, transcribed, translated, summarized, analyzed, and used for service delivery, quality assurance, support, safety, fraud prevention, training, improvement, and legal compliance. If you do not want a call recorded, do not continue the call; use the website or emailsupport@tikkaburrito.com instead.
8. Payments, Credits, and Plans
Some features require credits, subscriptions, usage fees, or paid plans. Prices, credit costs, included usage, limits, and feature availability may change. Credits may be consumed by AI generation, deployment, database provisioning, calls, messages, support workflows, or other actions described in the Service.
Payments are processed by third-party payment providers. You authorize us and our payment processors to charge the payment method you provide for applicable fees, taxes, renewals, usage, and plan changes. Except where required by law or expressly stated by us, fees and credits are non-refundable and non-transferable.
9. Third-Party Services and Open Source
The Service depends on third-party providers, including AI providers, hosting providers, communications providers, payment processors, authentication providers, databases, GitHub, domain providers, analytics, monitoring, and open-source packages. Your use of those services may be subject to their own terms, privacy policies, licenses, limits, outages, and fees.
Generated apps may include open-source packages or third-party code. You are responsible for reviewing and complying with applicable licenses, notices, attribution requirements, security updates, and restrictions.
10. Feedback and Support
If you send ideas, suggestions, bug reports, support messages, transcripts, examples, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation for support, product development, service improvement, training, marketing, and other business purposes, subject to our Privacy Policy.
11. Suspension and Termination
We may suspend, limit, or terminate access to the Service, remove content, disable deployments, block messages, or refuse work if we believe you violated these Terms, created risk for users or third-party providers, failed to pay fees, generated abuse complaints, exposed secrets, infringed rights, or used the Service unlawfully or unsafely.
You may stop using the Service at any time. Account closure does not affect obligations that should reasonably survive, including payment obligations, ownership and license provisions, disclaimers, liability limits, indemnity, and provisions needed for backups, legal compliance, and dispute resolution.
12. Disclaimers
To the maximum extent permitted by law, the Service and all Output are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, reliability, and uninterrupted or error-free operation.
We do not guarantee that generated apps will compile, run, deploy, be secure, be lawful for your use case, meet your requirements, or remain available. Third-party outages, provider limits, network problems, model behavior, carrier filtering, app-store rules, or hosting restrictions may affect the Service.
13. Limitation of Liability
To the maximum extent permitted by law, TikkaBurrito will not be liable for indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages; lost profits, revenue, goodwill, data, business opportunities, or anticipated savings; or damages arising from AI Output, generated code, third-party services, deployments, downtime, security incidents, messaging delays, or your apps and end users.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to TikkaBurritofor the Service in the three months before the event giving rise to the claim or 100 US dollars.
14. Indemnity
You will defend, indemnify, and hold harmless TikkaBurrito, its owners, employees, contractors, service providers, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your apps, your end users, your deployments, your connected services, your use of Output, your violation of these Terms, or your violation of law or third-party rights.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms, updating the date above, or sending an in-app, email, SMS, or account notice when appropriate. Continued use of the Service after changes become effective means you accept the updated Terms.
